The following promotion is intended for participants in the United States only and shall be construed and evaluated according to the laws of the United States. Do not proceed in this promotion if you are not a legal resident of the United States or not currently located in the United States. Further eligibility restrictions are contained in the official rules below.
1. DESCRIPTION: NO PURCHASE NECESSARY TO ENTER OR WIN. The “Honda CR-Z Summer Sweepstakes" ("Sweepstakes") begins on Saturday, June 19 at 12:01 am Pacific Time ("PT") and ends on Sunday, August 29 at 11:59 pm PT ("Sweepstakes Period"). The sponsor of this Sweepstakes is American Honda Motor Co., Inc. (“Sponsor”). The promotional participant is Disney Destinations, LLC (“Disney”). The administrator of this Sweepstakes is Creative Zing Promotion Group ("Administrator").
2. ELIGIBILITY: This Sweepstakes is open only to legal residents of the 50 states of the United States and the District of Columbia, who are physically located and residing therein and who are at least 18 years of age and have reached the age of majority in their state of primary residence at the time of entry (“Entrant”). Entrants must be licensed drivers in their state of residence. Employees of Sponsor, Disney, Administrator, Rubin Postaer and Associates, their advertising or promotion agencies, those involved in the production, development, implementation or handling of this Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers and fulfillment companies, any other person or entity associated with this Sweepstakes (collectively, the "Sweepstakes Entities") are ineligible to enter or win this Sweepstakes. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. Void in Guam, the U.S. Virgin Islands, Puerto Rico and where prohibited or restricted by law.
3. HOW TO ENTER: There are three (3) methods of entry available for the Sweepstakes. 1.) Online Entry: Entrants may enter the Sweepstakes online by visiting SummerFunWithHondaCRZ.com (“Web site”) and following the on-screen instructions to complete the registration form and the questionnaire. Once complete, Entrant must click “submit” to receive one (1) entry into the Sweepstakes. Online entries must be received by 11:59 pm on Sunday, August 29, 2010.
2.) On-Site Kiosk Entry: Entrants visiting Disneyland® Park (“Park”) during the Sweepstakes Period may enter on-site at the interactive Sweepstakes kiosks. Kiosks will be located adjacent to the Honda CR-Z display in the Innoventions attraction in the Park. Entrant must follow the on-screen instructions to complete the registration form and questionnaire. Kiosk entries must be received by 11:59 pm on Sunday, August 29, 2010.
3.) Mail-In Entry: A Honda CR-Z handout, which includes the Sweepstakes mail-in entry form and questionnaire, will be available at several locations at Disneyland® Resort (“Resort”). Entry forms will NOT be collected at the Resort. Completed entry form must be mailed to: Honda CR-Z Summer Sweepstakes c/o Creative Zing, PO Box 3827, Orlando, FL 32802-3827. Mail-in entries must be postmarked by August 30, 2010 and received by September 7, 2010. Limit one (1) entry per outer stamped envelope. No mechanically reproduced entries permitted. Illegible/incomplete entries are void. Limit of one (1) entry per person and/or email address per day regardless of method of entry, not to exceed 72 total entries for the duration of the Sweepstakes. Entries in excess of the limits stated herein will result in disqualification of the Entrant. Separate theme park admission is required to enter the Park and participate via entry method two (2)). Entry questionnaire is for ENTERTAINMENT PURPOSES ONLY and incorrect answers will have no bearing on the outcome of the Sweepstakes. Entries generated by a macro, script or other automated means will be disqualified. Each Entrant must be the rightful owner (or have authorized use) of the email address used for entry. In the event of a dispute as to the identity of an online Entrant or winner, the Entrant or winner will be deemed to be the person in whose name the email account was opened. Incomplete, unreadable, or unintelligible entries will be disqualified. Entrants must provide all information requested to be eligible to win.
4. PRIZE (1 Total): One (1) Grand Prize Package will be awarded. Grand Prize Package consists of: One (1) 2011 Honda CR-Z EX Automobile (“Vehicle”) with standard factory equipment and one (1) four (4) day / three (3) night vacation trip (the “Trip”) for the Winner and up to three (3) travel companions (“Guests”) to the Resort in Anaheim, California. The Trip consists of: A.) one (1) consecutive three (3) night stay at a Resort or Resort area hotel as selected by Disney (one standard room, quadruple occupancy); B.) Roundtrip coach-class air travel for up to four (4) from the major metropolitan airport in the U.S. nearest winner’s residence to a Southern California area airport, as determined by Disney in its sole discretion (air transportation provided www.disneyphotopass.com (terms and conditions, including required registration, apply); and F.) one (1) Disney Gift Card for winner valued at $500. Manufacturer’s Suggested Retail Price (“MSRP”) of Vehicle, including destination and handling charges will be between $20,000 - $24,000 (pending final determination of Vehicle MSRP by Sponsor). Approximate Retail Value (“ARV”) of Trip: $ 5,494.00. Total MAXIMUM Promotional Value: $29,494.
Actual value of Grand Prize will depend on point of departure, any airfare fluctuations and seasonal pricing; any difference will not be awarded. GRAND PRIZE WINNER AND GUESTS MUST BE ABLE TO COMPLETE TRIP BY JUNE 30, 2011 OR THAT PORTION OF GRAND PRIZE WILL BE FORFEITED AND NO ADDITIONAL COMPENSATION WILL BE AWARDED. Vehicle prize includes destination charges and handling only. Vehicle awarded may differ from Vehicle shown in promotional materials. Vehicle color and equipment will be determined by Sponsor, in its sole discretion. Winners will be responsible for all taxes (federal, state, local and/or income) and all expenses not listed, including but not limited to travel to and from the participating Honda dealership, related to acceptance and use of the Vehicle Prize. American Honda Motor Co., Inc., will use all reasonable efforts, subject to availability, to deliver vehicle within 120 days of receipt of completed Affidavit/Release. Sweepstakes Entities not responsible for delays in delivery. Grand Prize winner must take delivery of prize Vehicle within 30 days of notice of availability from the Sponsor-selected dealer near Grand Prize winner’s residence and must present a valid driver’s license issued in his/her state of residence and evidence of legally required insurance at time of delivery. Grand Prize Winner will also be responsible for sales tax, luxury tax, extended warranties, registration, license, insurance fees, title, plates and cost of any available upgrade and/or optional equipment not provided with vehicle. Grand Prize Winner and Guests must travel together on same itinerary for the trip. If a Guest is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must arrange and pay for his/her travel, including, but not limited to, transportation, accommodations, and theme park tickets, unless determined to be the Grand Prize winner or an allotted Guest. Airline for Grand Prize Trip to be selected by Disney in its sole discretion. Airline carrier’s regulations and conditions apply. Trip is subject to air travel/hotel availability, holiday and blockout dates, and other restrictions/conditions and must be booked at least 45 days prior to the date of arrival. Theme park attractions and entertainment are seasonal and subject to change without notice. Once Trip dates have been booked, no change, extension or substitution of trip dates is permitted, except at Sweepstakes Entities sole discretion. If Grand Prize Winner elects to travel with fewer than three (3) Guests, no additional compensation will be awarded. Sweepstakes Entities will not replace any lost or stolen tickets or travel vouchers. Grand Prize Winner is solely responsible for all unspecified incidentals, including, but not limited to, additional transportation, meals, beverages, gratuities, phone calls, insurance, taxes, and any other expenses not specifically mentioned as being included. No substitution, transfer or cash equivalent for a prize (or prize component), except that Sweepstakes Entities, at their sole discretion, may substitute a prize (or prize component) with one of equal value due to prize unavailability. Grand Prize and Grand Prize notifications will be shipped within the 50 states of the U.S. and D.C. only. Any depictions of prizes are for illustrative purposes only. Winners will receive an IRS Form 1099 from the Sweepstakes Entities for the total ARV of the Prize (stated above) in the calendar year in which the Grand Prize was fulfilled.
5. ODDS OF WINNING: A total of 350,000 mail-in entry forms have been made available for this Sweepstakes. Odds of winning depend on the cumulative number of eligible mail-in, on-site and online entries received.
6. WINNER SELECTION AND NOTIFICATION: Potential Grand Prize Winner will be selected in a random drawing conducted by the Administrator from among all eligible entries received, on or about September 9, 2010. The potential winner will be notified by telephone, email and/or overnight mail within approximately five (5) days of the aforementioned drawing date. The potential winner must be able to receive telephone calls from an unlisted and/or blocked number. Messages may not be left. Administrator reserves the right to disqualify anyone not fully complying with the Official Rules. Winner will be required to respond (as directed) to the notification within 72 hours of first attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Administrator will randomly select an alternate winner from the remaining eligible entries. Potential Winner may be required to verify address and return within five (5) days an affidavit of eligibility, a liability release and (where imposing such condition is legal) (collectively, the "Prize Claim Documents") a publicity release. Failure of any winner to return the Prize Claim Documents within the specified time period may result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries for that prize. A prize will not be awarded until all such properly executed forms are returned. Guests will be required to verify address and to execute before a notary public an affidavit of eligibility and a liability/publicity release as directed prior to the travel departure date. Failure to return the executed Guest affidavit and release form within the specified time period may result in forfeiture of the prize.
7. CONDITIONS OF PARTICIPATION/RELEASES: All federal, state and local laws and regulations apply. By participating, each Entrant agrees to be bound by these Official Sweepstakes Rules and the decisions of the Sweepstakes Entities, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that he or she may win, each Entrant agrees to release the Sweepstakes Entities and each of their respective successors, employees, agents, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Each Entrant authorizes the Sweepstakes Entities to use his/her name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, and on a winner's list, if applicable, without further compensation unless prohibited by law. Sweepstakes Entities are not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sweepstakes Entities sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, liabilities or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize including participation in any activity or travel related thereto, or from participation in the Sweepstakes; (v) any inability of Winner to accept or use any prize (or portion thereof) for any reason and such prize or portion thereof shall be forfeited; or (vi) any printing, typographical, human administrative or technological errors in any materials associated with the Sweepstakes. Sweepstakes Entities disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. The applicable Sweepstakes Entities reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes (or any portion of the Sweepstakes) should a virus, bug, computer problem, unauthorized intervention or other cause or problem corrupt or inhibit the administration, security or proper play of the Sweepstakes and, in such situation, will select the winner(s) from eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by the Sweepstakes Entities. The applicable Sweepstakes Entities may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sweepstakes Entities representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8. DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of California, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
9. PRIVACY POLICY: Any personal information supplied by you will be subject to the privacy policies of the Sponsor and Disney posted at http://disney.go.com/corporate/privacy/pp_wdig.html. By entering the Sweepstakes, you grant Sponsor permission to share your email address and any other personally identifiable information with the other Sweepstakes Entities for the purpose of administration and prize fulfillment. Additionally, by opting-in to receive future communications from American Honda Motor Co., and/or Disney Destinations, LLC and its affiliated companies about the Walt Disney World® Resort, Disneyland® Resort and other Disney products and services by placing a mark within the associated box on the registration form, your information will be shared with Disney Destinations, LLC and its affiliated companies.
